Tustin Awards promises to:
1) Provide an order confirmation upon order receipt
2) Email a proof within 1-2 business days of order confirmation
3) Engrave awards with personalization as shown on the approved proof
4) Ship orders within 1-2 business days of proof approval
5) Ship orders according to customer instructions
Customers ordering online or via email will receive an e-mailed order confirmation to show that we received their order. Upon receiving orders, we process payment and pull award stock. If customers select an out-of-stock item, customers will be notified before production begins, and provided alternate award options. Tustin Awards reserves the right to refuse any order at any time, and for any reason. Tustin Awards is not responsible for extended production times caused by payment processing delays and/or invalid payment information.
Our production team inspects all of our plaques and awards before and after engraving to make sure they are free of scratches and/or defects. (Please note: small air pockets occasionally appear inside optic crystal awards; these air pockets are characteristic of optic crystal, and are not defects. Small air pockets may also appear in glued sections of awards. These air pockets are common in the gluing process, and are considered acceptable.) Tustin Awards carefully packages each award for shipping, and is not responsible for any product damage or breakage which occurs after product leaves our facility.
Prior to finalizing an order online or via email, customers must review their order carefully to ensure that all information they provide is correct (including, but not limited to: award style, size, and quantity; personalization content and instructions; payment and delivery information; shipping method; etc.) Failure to provide accurate information upon order submission may result in proof charges, production delays, and/or expedited shipping charges. Order errors caused by customers will be remedied and replaced as soon as possible, and re-billed with a 20% courtesy discount (no discount on shipping). Order errors caused by Tustin Awards will be remedied and replaced before customer presentation date at no charge.
When supplying artwork and/or logos to Tustin Awards, you assume full legal responsibility for the copyright authorization and reproduction of the material you provide. You take full liability for any legal ramifications that may result from copyright infringement and/or negligence. You also agree to allow Tustin Awards to use any logos you provide on sample awards. These samples may be displayed on our website, in our showroom, etc. Please see our Terms and Conditions for more information regarding logo usage.
Tustin Awards shall not be liable for any delay in delivery or for non-delivery caused in whole or in part by the occurrence of any contingency beyond the control of Tustin Awards or its suppliers, including, but not limited to: acts of God, floods, fires, war, sabotage, acts of civil disobedience, failure or delay in transportation, import quota restrictions, governmental laws, ordinances, rules and regulations, whether valid or invalid (including, but not limited to, priorities, requisitions, allocations and price adjustment restrictions), delay in clearing customs, labor disputes, shortage of labor, fuel, or raw materials, or machinery or technical failure. If any such contingency occurs, Tustin Awards may allocate production and deliveries among its various customers, including Buyer. Standard production time is 3 business days after proof approval. After we receive order and artwork from Buyer, we will e-mail a proof for approval. Proof creation, review and approval generally require 1-2 business days. Buyer must reply with any proof changes or approvals within 24 hours of receiving a proof to avoid production delays. After we receive proof approval, production begins and requires 1-2 business days. Shipping requires additional time as well. Tustin Awards is not responsible for extended production time caused by invalid payment information, product unavailability, poor quality customer supplied artwork, multiple/extensive proof revisions, etc. Production time does not include shipping. Please allow 1-5 business days for shipping, depending on the shipping method selected.
All awards are custom engraved and not returnable. To ensure order accuracy, Tustin Awards requires written approval for all proofs prior to engraving. Upon approving the proofs, the customer assumes all responsibility for order accuracy including, but not limited to: spelling, content, font selection, award quantity, award style, etc. If an error occurs on the part of Tustin Awards, the error will be corrected immediately and replacement awards will be provided before your event. Award replacements resulting from customer errors will be engraved and shipped as soon as possible, and will be billed again with a 20% courtesy discount (shipping will not be discounted; customer is responsible for any expedited freight charges, if required). Any orders returned to Tustin Awards will be refused.
Shipping and Handling
Tustin Awards inspects all awards for defects or errors prior to leaving the production facility, and carefully packages each order to ensure that every order arrives in exceptional condition. If an order arrives with damaged or missing product, customers must contact Tustin Awards within 48 hours of product receipt, email photos of the damaged awards and all packing materials to firstname.lastname@example.org, and retain all product and packing materials for UPS inspection, otherwise replacement charges will apply. Tustin Awards is not responsible for shipping delays caused by customer error, carrier error, inclement weather, etc.
Information Inaccuracy Disclaimer
Occasionally, information on our website may contain typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, production times, and availability. Tustin Awards reserves the right to correct any errors, inaccuracies, or omissions and to change or update any information at any time without prior notice (including after you have submitted your order).
Limitation of Warranties
With the exception of those listed above, Tustin Awards makes no additional warranties, express or implied, with respect to the products. Seller makes no warranties respecting the merchantability of the product or other suitability for any particular purpose or use, except that they shall conform to the specifications set forth on the written order.
Tustin Awards shall not in any event be liable for and customers shall not be entitled to, indirect, special, incidental, or consequential damages of any nature, including, but not limited to, loss of profit, promotional or manufacturing expenses, rush production or shipping charges, overhead, injury to reputation or loss of customers. In no event shall any claim of customers exceed the purchase price of the product with respect to which the claim is made. Failure by customers to give Tustin Awards written notice within 48 hours of delivery shall constitute a waiver by customers of all claims with respect to the product.
If Tustin Awards, in its sole discretion, determines that any sale of good subject to this Agreement would result in a loss to Tustin Awards as computed under its normal accounting procedures because of causes beyond the control of Tustin Awards, then Tustin Awards may terminate this Agreement in whole or in part without the liability for any delay in the delivery of or failure to deliver the goods.
